Terms of Service

1. Introduction

Welcome to ShowMyTrades, a trading analytics platform operated by VENUS LABS S.R.L. (VAT IT04090370364), with registered office at Via Pasubio 3, Bomporto, MO 41030, Italy (hereinafter "ShowMyTrades", "we", "us", or "our").

These Terms of Service ("Terms") govern your access to and use of ShowMyTrades' website, services, and applications (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OUR SERVICE.

2. Eligibility

You must be at least 18 years of age to use ShowMyTrades. By creating an account, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into these Terms
• You will provide accurate and complete information during registration
• You will comply with all applicable laws and regulations

3. Nature of the Service

3.1 Analytics Platform Only

ShowMyTrades is a trading analytics and performance tracking platform. We provide tools to:

• Sync trading data from MetaTrader 4, MetaTrader 5, NinjaTrader, cTrader, and TradeLocker accounts
• Calculate and display trading statistics and performance metrics
• Generate charts and visualizations of trading activity
• Share verified trading results with other users

3.2 What We Are NOT

ShowMyTrades is NOT:

• A broker or financial institution
• A fund manager or investment advisor
• A provider of financial, investment, or trading advice
• A copy trading or signal service
• Regulated by any financial authority as a financial services provider

3.3 No Copy Trading or Signal Following

Users cannot:

• Automatically copy trades from other users
• Execute trades through our platform
• Receive trading signals or recommendations from us

Any trading decisions you make are your sole responsibility.

4. Account Registration and Security

4.1 Account Creation

To use certain features of the Service, you must create an account by providing:

• Valid email address
• Secure password
• Any additional information required during registration

You are responsible for maintaining the confidentiality of your account credentials.

4.2 API Keys and Trading Account Connection

When connecting your MetaTrader, NinjaTrader, cTrader, or TradeLocker accounts, you will provide API keys, account credentials, or authorize access through OAuth.

You are solely responsible for:

• The security and confidentiality of your API keys
• Any activity that occurs through your connected accounts
• Ensuring you have authorization from your broker to use our Service
• Revoking access immediately if you suspect unauthorized use

4.3 Expert Advisor Data Collection

When you install our Expert Advisor ("EA") on your MetaTrader platform, you acknowledge and agree that the EA collects data directly from your MetaTrader terminal, including but not limited to:

• Symbol information and contract specifications
• Swap rates and spreads
• Past and current trades (open, closed, and pending orders)
• Account balance, equity, and margin information
• Other trading-related information available within your MetaTrader terminal

If you do not agree with this data collection, you may immediately remove our Expert Advisor from your MetaTrader platform and delete your trading account from ShowMyTrades. Deleting your trading account will permanently delete all data we have collected from it.

5. Acceptable Use Policy

5.1 Prohibited Activities

You agree NOT to:

• Create fake or fraudulent accounts
• Manipulate, falsify, or misrepresent trading data
• Upload an altered or fabricated strategy tester report, or present a backtest as the result of a real account (see Section 8.8)
• Use bots, scrapers, or automated tools to access the Service without authorization
• Engage in scams, fraudulent schemes, or misleading practices
• Sell "signals" or investment services using manipulated performance data
• Use the Service to solicit investments through false or misleading claims
• Impersonate other users or entities
• Harass, abuse, or harm other users
• Violate any applicable laws, regulations, or third-party rights
• Reverse engineer, decompile, or attempt to extract source code
• Introduce viruses, malware, or malicious code

5.2 Consequences of Violations

Violation of this Acceptable Use Policy may result in:

• Immediate account suspension or termination
• Permanent ban from the Service
• Removal of all associated data and content
• Legal action if applicable

6. Data Ownership and Intellectual Property

6.1 Your Trading Data

When you connect your trading accounts to ShowMyTrades:

• You retain ownership of your original trading data
• You grant ShowMyTrades a worldwide, non-exclusive, royalty-free license to use, store, display, and analyze your trading data to provide the Service
• This license includes the right to display your trading statistics publicly if you choose to make your profile public
• You waive any right to compensation or payment for the use of your data by ShowMyTrades

6.2 User-Generated Content

Any content you post on ShowMyTrades (comments, messages, profile information):

• Remains your property
• You grant us a license to display, store, and use such content to operate the Service
• Must comply with our Acceptable Use Policy
• Can be removed by us if it violates these Terms

6.3 ShowMyTrades Intellectual Property

All content, trademarks, logos, software, and technology used in the Service are owned by ShowMyTrades or our licensors.

MetaTrader®, MT4® and MT5® are registered trademarks of MetaQuotes Ltd.; cTrader is a trademark of Spotware Systems Ltd.; TradeLocker is a trademark of its owner. These names and logos appear in the Service only to indicate compatibility. ShowMyTrades is an independent product and is not affiliated with, endorsed by or certified by any of them.

6.4 Promotional and Advertising Use

You grant ShowMyTrades a worldwide, non-exclusive, royalty-free license to use, reproduce, and display the content you have chosen to make public (including your public account and portfolio pages, trading statistics, charts, username or brand name, avatar, and screenshots of those pages) for promotional, marketing, and advertising purposes.

• This includes paid advertising campaigns, social media posts, newsletters, blog articles, presentations, and any other marketing material, online or offline
• We may feature your public account as an example of how the Service is used, without prior notice
• Only content you have made public is used this way. Private and unlisted accounts, private portfolios, messages, and your email address are never used in advertising
• Data that is not public may be used for these purposes only in anonymized, aggregated form
• You waive any right to compensation for such promotional use
• You can opt out at any time by setting your account or profile to private or unlisted, or by writing to support@showmytrades.com. We will stop using your content in new material; material already published or distributed may not be immediately recallable

6.5 Developer API, MCP Server and Attribution

The Developer API and the MCP server are free to use. On the free plan, wherever you display data obtained through them you must show the credit "Data from ShowMyTrades" as a visible, working link to the address provided in the response, without a nofollow attribute. On paid plans the credit is recommended but not required. We may revoke a Developer API Key used to display data without the required credit or beyond the published rate limits.

7. Public Profiles and Privacy

7.1 Public Profile by Default

7.2 Data Processing

We process your personal data in accordance with:

• The General Data Protection Regulation (GDPR)
• Italian data protection laws
• Our Privacy Policy (available separately)

7.3 No Sale of User Data

We do NOT sell your personal data or trading data to third parties. We may share aggregated, anonymized data for research or business purposes.

7.4 Referral Program: Information Shared With Whoever Invited You

If you create your account through another user's referral link or invitation, that user (and, where an affiliate or partner program applies, the affiliate whose link you used) will be able to see the following information about your account, so that referral rewards can be verified:

• Your display name (which may be your first and last name if you sign up with Google) and your profile picture
• The date you registered on ShowMyTrades
• Your qualification status for the referral program: whether you have connected a live (non-demo) trading account, and whether that account has reached at least 20 closed trades

Nothing else is shared with them. Your email address, your trading results, your balance, your broker, your account numbers and any private data of yours are never disclosed to the person or affiliate who invited you.

By signing up through a referral link you accept this disclosure, which is necessary to operate the referral program and to allow rewards to be earned and verified. You may change your display name and profile picture at any time in your account settings.

Partners and affiliates. If the person or company that referred you, or whose benefit you activated, is a business partner or affiliate of ShowMyTrades (for example a broker, a VPS provider or a partner offering a free plan to its clients), a broader set of data about you and your connected trading accounts, including private ones, may be shared with that partner, as described in Section 5.3b of our Privacy Policy.

8. Disclaimers and Limitations of Liability

8.1 No Warranties

We specifically disclaim:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Any guarantee of accuracy, completeness, or reliability of trading data
• Any guarantee of uninterrupted or error-free service
• Any responsibility for data synchronization failures or delays

8.2 Data Accuracy Disclaimer

WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY TRADING DATA, STATISTICS, OR METRICS DISPLAYED ON OUR PLATFORM.

While we strive to provide accurate analytics:

• Data may be incomplete, delayed, or incorrect due to technical issues
• Third-party data sources (brokers, MetaTrader servers) may provide inaccurate information
• Calculations and statistics are provided "as is" without certification or verification
• You should independently verify all trading data before making any financial decisions

8.3 No Financial Advice

NOTHING ON SHOWMYTRADES CONSTITUTES FINANCIAL, INVESTMENT, OR TRADING ADVICE.

• We do not recommend any trading strategies, securities, or financial products
• Performance of other users is not indicative of future results
• Past performance does not guarantee future success
• You are solely responsible for your own trading decisions

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOWMYTRADES AND VENUS LABS S.R.L. SHALL NOT BE LIABLE FOR:

• Any trading losses or financial damages resulting from your use of the Service
• Errors, inaccuracies, or omissions in trading data or analytics
• Service interruptions, technical failures, or data loss
• Unauthorized access to your account or data breaches
• Actions or conduct of other users on the platform
• Any indirect, incidental, consequential, or punitive damages

8.5 User Interactions and Investments

WE ARE NOT RESPONSIBLE FOR:

• Interactions between users on the platform
• Any investment arrangements made between users
• Scams, fraud, or misrepresentation by users
• Verification of user identities or credentials
• Monitoring or policing user communications

If you choose to invest with or follow strategies of other users, you do so entirely at your own risk. We do not endorse, verify, or guarantee any user's trading performance or claims.

8.6 High Risk Trading Warning

The performance data displayed on ShowMyTrades represents historical results and does not guarantee future performance. Trading results shown may be hypothetical or based on actual accounts, but in all cases:

• Historical performance does not predict future returns
• Individual results may vary significantly
• Actual trading involves financial risk that cannot be fully replicated in historical data
• Market conditions change and past strategies may not work in the future

8.7 Hypothetical Performance Results

HYPOTHETICAL PERFORMANCE RESULTS HAVE MANY INHERENT LIMITATIONS. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown on our platform.

Key limitations include:

• Hypothetical results are generally prepared with the benefit of hindsight
• Hypothetical trading does not involve financial risk
• No hypothetical trading record can completely account for the impact of financial risk in actual trading
• The ability to withstand losses or adhere to a particular trading program in spite of trading losses are material points which can adversely affect actual trading results
• Numerous factors related to markets in general or to the implementation of any specific trading program cannot be fully accounted for in hypothetical performance results

Performance results displayed do not account for:

• Spreads and commissions charged by your broker
• Slippage in order execution
• Latency and connection issues
• Psychological factors affecting real trading decisions

8.8 Backtests (Strategy Tester Reports)

Users may upload reports produced by the strategy tester of a trading platform (for example MetaTrader 4, MetaTrader 5 or cTrader). ShowMyTrades turns such a report into a page similar to the page of a trading account. A BACKTEST IS A SIMULATION ON HISTORICAL DATA. IT IS NOT A TRADING ACCOUNT, NO MONEY WAS EVER AT RISK, AND EVERYTHING IT SHOWS IS HYPOTHETICAL PERFORMANCE within the meaning of Section 8.7.

• Labelling: every backtest page, title and preview is marked "Backtest". A backtest never receives the verification badges of a trading account (Real Account, Track Record Verified, Trading Privileges Verified)
• Who produced it: the report is generated by the uploading user on their own computer, with settings, historical data quality, spread, commission and slippage assumptions chosen by them. We do not run, reproduce or audit the test
• Consistency checks are not a verification: before accepting a report we check that its numbers are consistent with each other and with its list of trades. These checks can detect many altered reports, but they cannot prove that a report is genuine, that the strategy exists, or that it would have obtained the same results on a real account. "Consistency checks passed" means only that
• Known limits of backtests: results depend on the quality of historical data and on the modelling method; strategies are often optimised on the same data they are tested on (curve fitting); real execution differs because of liquidity, slippage, latency, requotes, swaps and broker conditions
• Your responsibility as uploader: you may upload only reports you generated yourself or have the right to publish, exactly as the platform produced them. Uploading an altered or fabricated report, or presenting a backtest as the result of a real account, is a Prohibited Activity under Section 5.1
• Original file: the original report you upload is stored and, if you publish the backtest, can be downloaded by visitors together with its images
• Removal: we may reject, unpublish or delete any backtest, at any time and without notice, in particular when we believe a report has been altered

DO NOT MAKE INVESTMENT DECISIONS, AND DO NOT BUY A TRADING ROBOT, SIGNAL OR COURSE, ON THE BASIS OF A BACKTEST. Past simulated performance says little about future real performance.

9. User Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS ShowMyTrades, VENUS LABS S.R.L., and their respective officers, directors, shareholders, employees, agents, affiliates, and partners from and against any and all third-party claims, liability, damages, losses, costs, expenses, fees (including reasonable attorneys' fees and court costs) that arise from or relate to:

• Your use or misuse of the Service
• Your violation of these Terms of Service
• Your violation of any applicable laws, regulations, or third-party rights
• Your trading activities or investment decisions
• Content or information you submit, post, or transmit through the Service
• Your infringement of any intellectual property or other right of any person or entity
• Any fraudulent, negligent, or willful misconduct by you
• Claims made by other users based on your actions or content

This indemnification obligation will survive termination of your account and these Terms.

10. User Responsibilities and Compliance

10.1 Account Security and Notification

You are solely responsible for:

• Maintaining the confidentiality of your account password and API keys
• All activities that occur under your account
• Immediately notifying us of any unauthorized access or security breach by contacting support@showmytrades.com
• Ensuring that your login credentials are not shared with any third party
• Logging out from your account at the end of each session when using public or shared computers

Failure to notify us promptly of unauthorized access may result in your liability for losses incurred by ShowMyTrades or other users.

10.2 Legal and Regulatory Compliance

By using ShowMyTrades, you agree to comply with all applicable laws and regulations, including but not limited to:

• Securities and financial trading regulations in your jurisdiction
• Anti-money laundering (AML) and know-your-customer (KYC) requirements
• Tax reporting obligations
• Laws prohibiting market manipulation, insider trading, or fraudulent trading practices
• Data protection and privacy laws (including GDPR)
• Export control laws and economic sanctions

You must not use our Service to:

• Manipulate trading data to deceive others
• Make false or misleading statements about trading performance
• Violate any broker terms of service or exchange rules
• Engage in any illegal or fraudulent activity

10.3 System and Network Security

You agree NOT to:

• Attempt to gain unauthorized access to our systems, servers, or networks
• Use any automated scripts, bots, or scrapers without written permission
• Overload, flood, spam, or crash the Service
• Probe, scan, or test the vulnerability of our systems
• Breach or circumvent any security or authentication measures
• Access data not intended for you or log into servers or accounts you are not authorized to access

Violations may result in immediate account termination and potential legal action.

10.4 Download and Material Risks

Any material downloaded or otherwise obtained through the use of the Service is at your own discretion and risk. You are solely responsible for:

• Any damage to your computer system, mobile device, or other equipment
• Any loss of data that results from the download or use of any material
• Ensuring your system has adequate virus protection and security measures
• Backing up your important data before using our Service

We are not responsible for any harm to your devices or data loss resulting from your use of ShowMyTrades.

10.5 Email and Electronic Communications

By creating an account, you agree to receive all required notices, agreements, and communications electronically, including:

• Important updates to these Terms of Service
• Security alerts and notifications
• Account-related communications
• Service announcements and new feature notifications

It is your responsibility to:

• Keep your email address current and valid
• Check your email regularly for important communications
• Update your email address immediately if it changes
• Ensure our emails are not blocked by spam filters

You are deemed to have received any email communication within 24 hours of us sending it, whether or not you actually read it.

10.6 Third-Party Links and Services

The Service may contain links to third-party websites, services, or resources (such as broker websites, educational content, or partner services). These links are provided for your convenience only.

We do not:

• Endorse or recommend any third-party services
• Verify the accuracy or reliability of third-party content
• Control or monitor third-party websites
• Accept responsibility for third-party content, products, or services

Your use of third-party websites is at your own risk and subject to the terms and conditions of those third parties.

10.7 Affiliate Links and Broker Relationships

Some links on the Service, including links to brokers, may be affiliate links. If you click an affiliate link or open an account through it, we may receive a commission or other compensation from the third party, at no additional cost to you.

Any broker-related information we display (including estimated cost or savings comparisons based on your own trading data) is provided for informational purposes only. It is not financial advice and does not constitute an endorsement, recommendation, or guarantee of any broker. You are solely responsible for evaluating and choosing your broker.

10.8 Affiliate Program

ShowMyTrades operates an affiliate program. Participation requires an application and is subject to manual approval at our sole discretion. The following terms apply to approved affiliates:

• Commissions. Affiliates earn recurring commissions on payments made to ShowMyTrades by users attributed to them. Commission rates are tiered based on the affiliate's cumulative sales volume; we may agree individual rates with specific affiliates. Rates and tiers may be updated for future payments.
• Attribution. Users are attributed to an affiliate at the time they sign up, based on the referral link or referral cookie active at that moment, and the attribution is permanent. Commissions accrue only on payments actually received by us; refunded payments are deducted accordingly.
• Commissions replace invite rewards. ShowMyTrades separately offers free Pro time as a reward for inviting qualified traders. These two benefits do not stack. While you are an affiliate, users you invite generate commissions instead of free Pro time. Any Pro time earned before joining the program remains yours until it expires; after that, Pro access is paid like for any other user. If you leave the program, new invites earn Pro time again, but users attributed to you during your affiliate period never convert into Pro time.
• Payouts. Payouts are made by bank transfer or PayPal to the details you provide, upon your request, once your unpaid balance reaches the minimum payout threshold (currently $50). We may require additional information (including tax-related information, where applicable) before processing a payout.
• Conduct. Self-referrals, misleading promotion, spam, and any artificial or fraudulent activity are strictly prohibited.
• Termination and revocation. We may modify, suspend, or terminate the program, or any individual participation, at any time, for any reason we deem appropriate, at our sole discretion and without prior notice. We may likewise withhold, revoke, or cancel commissions, including accrued and unpaid commissions, where we determine, at our sole discretion, that they arise from or are connected to fraud, abuse, prohibited conduct, or any violation of these Terms. Our determination in these matters is final, and nothing in this section obliges us to pay out commissions to participants removed from the program.

11. Pricing and Payment Terms

11.1 Free Tier

ShowMyTrades currently offers a free tier with access to core features including:

• Unlimited MetaTrader account connections
• Real-time trade synchronization
• Advanced statistics and analytics
• Public profile pages

11.2 Paid Plans

We may introduce premium paid plans in the future with additional features. When paid plans become available:

• Pricing will be clearly displayed on our website
• You will be notified of any changes to your subscription
• Payments will be processed through secure third-party payment processors (PCI-DSS compliant)
• Subscriptions may be subject to additional terms

11.3 Refund Policy

All sales are final. We do not offer refunds or exchanges for any products or services once a purchase is completed, under any circumstances.

NO EXCEPTIONS. No refunds will be provided for:

• Change of mind or buyer's remorse
• Technical issues or service interruptions
• Duplicate purchases or erroneous orders
• Dissatisfaction with the service
• Account termination or suspension
• Any other reason whatsoever

By completing a purchase, you acknowledge and accept that all payments are non-refundable.

11.4 Changes to Pricing

We reserve the right to:

• Modify pricing for paid plans at any time
• Introduce new paid features
• Limit features previously available in the free tier
• We will provide at least 30 days' notice before reducing features in the free tier or increasing prices for existing subscribers

11.5 Live Sync

Live Sync is an optional paid add-on that gives one eligible trading account (a MetaTrader account connected with its investor password) real-time updates instead of the standard sync interval. The following terms apply in addition to the rest of this Section 11:

• Per account, billed yearly in advance. Each Live Sync subscription (a "seat") covers one trading account at a time and renews automatically every year until you cancel it from your Billing settings. Cancelling stops the renewal; the seat stays active until the end of the period already paid.
• No refunds, including for unused time. Section 11.3 applies in full. In particular, no refund or credit is given if you stop using, disconnect, delete or move the account, if the account's investor password stops working or is changed, if the account is closed by your broker, or if you cancel before the end of the paid period.
• Moving a seat. You may move a seat to another eligible account of yours at any time, up to 3 times per day and 6 times per 30 days per seat. A seat with no account assigned stays paid and can be assigned later; it is not refunded.
• Eligibility. Live Sync only works on accounts we can update with the investor password you provided. If the credentials are invalid or the broker does not allow the connection, updates stop until you fix them; the subscription continues and no refund is due.
• Best effort. "Real-time" means updates within seconds under normal conditions. Update frequency depends on your broker's servers and on third parties outside our control; occasional delays or interruptions are not a basis for refunds or compensation (see Section 8).
• Visibility. When Live Sync is active on an account, its public page may show that the account is updated in real time.

12. Account Termination

12.1 Termination by You

You may cancel your account at any time by:

• Using the account deletion feature in your settings
• Contacting our support team at support@showmytrades.com

Upon termination:

• Your account will be deactivated
• Your public profile will be removed
• Your trading data may be retained for a limited period as required by law or for legitimate business purposes

12.2 Termination by Us

We may suspend or terminate your access to all or any part of the Service immediately, without notice, for conduct that ShowMyTrades believes violates these Terms or any policies, or for any other reason in our sole discretion, including but not limited to:

• Violation of these Terms of Service
• Engagement in prohibited activities listed in Section 5
• Suspected fraudulent, abusive, or illegal activity
• Required by law or regulatory authorities
• Discontinuation of the Service (with reasonable notice)

ShowMyTrades will bear no responsibility or liability from such action.

12.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We may delete your data in accordance with our data retention policies and applicable law
• Sections of these Terms that by their nature should survive (disclaimers, limitations of liability, indemnification, dispute resolution) will remain in effect
• You remain liable for any obligations incurred prior to termination

13. Modifications to Terms of Service

We may modify, update, or change these Terms at any time without individual prior notice. When we make changes:

• We will update the "Last Updated" date at the top of this document
• We will notify you via email to your registered email address
• We may display a prominent notice on the Service
• Continued use of the Service after changes constitutes your acceptance of the new Terms

It is your responsibility to periodically review these Terms for any changes. If you do not agree to the modified Terms, you must immediately stop using the Service and close your account.

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

14.2 Jurisdiction

Any disputes, claims, or controversies arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Modena, Italy. By using the Service, you agree to submit to the personal jurisdiction of these courts.

14.3 Informal Resolution

Before initiating any legal proceedings, you agree to attempt to resolve disputes informally by contacting us at support@showmytrades.com with a detailed description of the dispute. We will attempt to resolve the dispute in good faith within 30 days.

14.4 GDPR Compliance and Data Rights

As a company operating within the European Union, we comply with the General Data Protection Regulation (GDPR). You have the right to:

• Access your personal data
• Rectify inaccurate data
• Request erasure of your data (right to be forgotten)
• Object to or restrict data processing
• Data portability
• Lodge a complaint with a supervisory authority

For GDPR-related requests, contact us at support@showmytrades.com. We will respond to your request within the timeframes required by applicable law.

15. Miscellaneous

15.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and ShowMyTrades regarding the Service and supersede any prior agreements or understandings.

15.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid provision will be replaced with an enforceable provision that comes closest to the intention underlying the invalid provision.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or provisions. Any waiver of any provision of these Terms will be effective only if in writing and signed by ShowMyTrades.

15.4 Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to any affiliate, successor, or acquirer without restriction or notification.

15.5 Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:

• Acts of God, natural disasters, or severe weather
• War, terrorism, riots, or civil unrest
• Pandemics, epidemics, or public health emergencies
• Government actions, laws, or regulations
